He becomes the first chief minister to be arrested while in office with this, the case’s most publicized arrest. In response to several pleas seeking a stay of the Chief Election Commissioner and Other Election Commissioners Act, 2023—which removes the Chief Justice of India from the panel responsible for selecting election commissioners—the Supreme Court issued its ruling today.

While acknowledging that the Union government acted hastily, the bench made up of Justices Sanjiv Khanna and Dipankar Datta declined yesterday to stay the law and order a new panel made up of the CJI to select Election Commissioners. At the time, it had stated that the decision’s justifications would be provided.
